1. General provisions
1.1.
These Terms of Service (the “Terms”) govern the relationship between the administration of the Telenoda service (the “Administration”) and an individual who uses the Telenoda messenger (the “User”).
1.2.
Telenoda (the “Service”) includes the mobile apps, the web version web.telenoda.org, the websites telenoda.org and core.telenoda.org, the programming interface for bots (Bot API) and related services.
1.3.
The Terms are a public offer (Article 437 of the Civil Code of the Russian Federation). By registering with or using the Service, the User accepts the Terms in full and without reservation (Article 438 of the Civil Code of the Russian Federation). If the User does not agree with the Terms, they may not use the Service.
1.4.
The Terms include the Privacy Policy and, for bot owners, the rules published in the developer documentation. Consent to the processing of personal data is given separately.
1.5.
The Service is provided free of charge. If paid features appear in the Service, their terms will be published before they take effect.
2. Registration and account
2.1.
To register, the User provides a mobile phone number and confirms it by a method offered by the Service. The phone number is the account identifier. Users are identified by their subscriber number in the manner established by the legislation of the Russian Federation.
2.2.
The Service may be used by persons aged 14 and over.
2.3.
The User undertakes to provide accurate information, not to create accounts on behalf of other persons without their consent, not to give third parties access to the account, and to keep their devices, verification codes and PIN safe.
2.4.
Actions performed using the account are deemed to have been performed by the User until the User terminates the session on a lost device or notifies the Administration of unauthorized access.
2.5.
The User may stop using the Service and delete the account at any time in the app settings (“Privacy → Delete account”).
3. Rules of use
3.1.
The User uses the Service in accordance with the law and these Terms.
3.2.
It is prohibited to:
- distribute information whose distribution is prohibited by the legislation of the Russian Federation or of the User's country of residence, including calls for violence, extremist and terrorist activity, material involving the sexual exploitation of minors, and information on how to make or obtain narcotic drugs and weapons;
- violate the rights of third parties, including intellectual property rights and the right to privacy, or distribute the personal data of other persons without their consent;
- send spam and bulk messages without the recipients' consent, engage in fraud and phishing, or impersonate another person or the Administration;
- distribute malware, attempt to gain unauthorized access to accounts, devices and the Service's infrastructure, interfere with its operation or circumvent technical restrictions;
- use unofficial clients and automated means of accessing the Service other than the Bot API, or automatically collect data of other users.
3.3.
The User is solely responsible for the content of the messages and materials they send and publish.
4. Channels, groups and public content
4.1.
Owners and admins of channels and groups are responsible for compliance with the rules in their communities and must remove infringing material they become aware of.
4.2.
Content of public channels and groups is accessible to an unlimited number of people, including on preview pages on the Service's website.
5. Bots and mini apps
5.1.
Bots and mini apps are created by third-party developers. The Administration is not a party to the relationship between the User and the bot owner and is not responsible for the content and operation of bots, except as expressly provided by law.
5.2.
The bot owner:
- keeps the bot token secret and is responsible for all actions performed with it;
- complies with Bot API limits and does not send messages without users' consent;
- does not ask users for verification codes, PINs or other Telenoda sign-in data;
- processes the personal data of the bot's users as an independent operator in accordance with applicable law and publishes their own data processing policy.
5.3.
The Administration may restrict the operation of a bot, its mini apps or inline mode, revoke the token and delete the bot if the Terms are violated or as required by law.
6. Intellectual property rights
6.1.
The exclusive rights to the Service, including software, design and logos, belong to the Administration or its licensors. The User is granted a simple (non-exclusive) royalty-free license to use the Service's apps for their intended purpose worldwide for the period of use of the Service.
6.2.
The rights to the materials the User sends and publishes remain with the User. The User grants the Administration a simple (non-exclusive) royalty-free license to store, reproduce and transmit such materials to the extent necessary for the operation of the Service — delivery, synchronization and display to recipients and community members — for the period they are stored in the Service.
7. Reports, moderation and restrictions
7.1.
A message, account, bot, group or channel can be reported using the Service's tools, including in the support chat.
7.2.
The Administration reviews reports and may remove material, restrict access to it, restrict account features, or temporarily or permanently block an account, bot or community if the Terms or legal requirements are violated, including at the request of authorized government bodies.
7.3.
The Administration does not pre-screen messages and does not read private chats. Moderators only have access to public content and to material attached to a report.
7.4.
The Administration notifies the User of a restriction and its reason unless prohibited by law or this creates a security threat. The decision can be appealed via the support chat; the appeal is reviewed within 30 days.
8. Personal data and legal requirements
8.1.
The User's personal data is processed in accordance with the Privacy Policy.
8.2.
The Administration fulfils the obligations established by the legislation of the Russian Federation on information, information technologies and the protection of information, including storing information and providing it to authorized government bodies in the cases and manner provided by law.
9. Liability
9.1.
The Service is provided “as is”. The Administration strives to ensure continuous and secure operation of the Service but does not guarantee the absence of interruptions and errors, including those caused by third parties, telecom operators and equipment failures.
9.2.
The Administration is not responsible for the content of messages and materials of users and bots, for the actions of third parties, or for the User's indirect losses and lost profits.
9.3.
Limitations of liability apply to the extent permitted by applicable law. They do not limit liability for intentional acts and gross negligence, nor consumer rights that cannot be limited by contract.
10. Changes to the Terms and the Service
10.1.
The Administration may change the Terms. The User is notified of material changes in the Service at least 14 days before they take effect, except for changes required by law or by security threats.
10.2.
Continued use of the Service after the changes take effect means acceptance of them. If the User does not agree with the changes, they may stop using the Service and delete the account.
10.3.
The Administration may change the features of the Service and end support for outdated app versions.
11. Term and termination
11.1.
The Terms remain in effect until the account is deleted.
11.2.
The Administration may stop providing the Service to the User in the event of a material or repeated violation of the Terms, notifying the User as described in the section “Reports, moderation and restrictions”.
12. Governing law and disputes
12.1.
The Terms are governed by the law of the Russian Federation.
12.2.
Disputes are resolved through negotiation. A claim is sent to the support chat in the app; the response time is 30 days. If no agreement is reached, the dispute is referred to court in accordance with the legislation of the Russian Federation.
13. Contacts
13.1.
You can contact the Administration in the support chat in the Telenoda app (Settings → Ask a Question).
